Villa Rental - Terms & Conditions

Contract of Hire

All bookings must be acknowledged and agreed by La Marina Services International CB. All bookings are subject to the following terms and conditions which are deemed to have been accepted in full by the hirer and all persons in their party. Bookings must be made by post, fax, e-mail or via our web site booking form. Bookings by telephone must be followed up by written confirmation via one of these methods. All bookings may only be considered to have been accepted when payment of the required deposit is received by La Marina Services International CB.

Deposit

A non-refundable deposit of 20% of the total cost is required to secure your booking. Bookings will be held provisionally for one week or until the required deposit is received by La Marina Services International CB, whichever is sooner. If your booking is made eight weeks or less before the hire commencement date it must be accompanied by full payment. Should we not receive full payment within one week then the provisional booking will be cancelled. Payment can be made by in cash at our office, by cheque, via bank transfer, or PayPal.

Confirmation of Booking

Your booking will only be confirmed on receipt of your deposit. Confirmation will be sent to you either by post, fax, or e-mail stating the outstanding balance and due date of the final payment.

Final Payment

The outstanding balance must be paid eight weeks prior to the hire commencement date in cash at our office, by cheque, via bank transfer, or PayPal. If your booking is made eight weeks or less before the hire commencement date it will be deemed provisional for one week or until full payment is received, whichever is sooner. If we do not receive the balance by the seventh week prior to your rental commencement date, we shall be entitled to cancel the booking without prejudice.

Form of Payment

All payments prior to your arrival date can be made in cash at our office, by cheque, via bank transfer, or PayPal.

Payments made during the villa hire period must be paid at our office in cash in Euro.

Refund of the damage waiver deposit (if applicable) will be refunded to you by bank transfer only.

Cancellation by the Hirer

All cancellations of bookings must be made in writing and notified to and received by La Marina Services International CB no later than eight weeks prior to the hire commencement date. If the booking is cancelled by you prior to this deadline the deposit only will be forfeited. If cancellation is less than eight weeks before hire commencement date, the full cost of the villa rental will become payable.

Alterations and Cancellations by La Marina Services International CB

In the unlikely event that a villa becomes unavailable due to circumstances beyond the control of La Marina Services International CB, the hirer will be offered alternative accommodation of an equal or superior quality if such accommodation is available, or a full refund of all money paid to La Marina Services International CB to date. In the event that no suitable accommodation can be offered then a full refund of all money paid to La Marina Services International CB to date, will be made. Any refund is restricted to the villa hire costs and we cannot accept liability for any cancellation or administration charges for travel arrangements, insurance, etc.

Amendments by the Hirer

In the event that you wish to alter any details of a fully confirmed booking less than eight weeks prior to the hire commencement date, La Marina Services International CB reserve the right to make an additional administration charge of 30 Euro per change in addition to any increased cost of the revised arrangement, if applicable. Confirmation of any such amendments must be sent by you to La Marina Services International CB in writing by post, fax, or e-mail prior to your arrival.

What is included?

You are hiring a self-catering villa. A free welcome pack of tea, coffee, sugar and bottled water will be provided. Any additional items that may be required will have to be ordered and paid for in advance. The villa rental price includes the cost of the following; a weekly change of bed linen and tea towels, end of stay clean, mains water, electricity, gas, and use of air conditioning and/or swimming pool (where installed). Travel cots, high chairs, and other items can be hired at an additional cost and subject to availability. 

All villas are furnished and equipped. However, condition and availability of equipment varies. 

All villas have TV installed. However, quality and content cannot be guaranteed and are often unreliable.

What is not included!

The villa rental price does not include personal, accident, medical, travel or cancellation insurance. Neither does it include travel costs, transportation, airport transfers, full resort representation or mid-stay cleaning of the villa. 

Towels are for house use only. Beach towels are not provided.

Occupancy

Only persons listed on the booking form may occupy the villa. The villa must not be sublet to any other group/party or individual without the prior consent and written approval of the owners. 

Under no circumstances may there be any more than the maximum number of persons specified in the villa description, or booking form, occupying the villa except by prior written agreement. La Marina Services International CB reserves the right to evict from and/or refuse admittance to the villa to the hirer and their party if they are found or reported to be in breach of this condition.

We do not allow pets or animals into any of our villas. However, there may be certain circumstances in which it may be acceptable. An additional charge may be made required. Please contact us if you have any specific requirements. 

Hirer’s Responsibility

The hirer is responsible for taking care of the property and its contents. Any defects or deficiencies must be reported within 48 hours of your arrival. After this time it will be assumed that everything is in order. At the end of the hire period, the property and its contents, including all equipment, furniture, utensils, etc. must be left clean and tidy (this includes; crockery and cutlery to be cleaned and stored in the appropriate cupboards, and that the cooker, oven, fridge and microwave are left clean). The hirer must ensure that no member of the party engages in any activity in or around the villa and/or swimming pool which may cause damage to the structure, design, furniture, fixtures or fittings, danger to themselves or others, or offence or annoyance to the local community. The hirer shall also ensure that the barbecue is cleaned safely after use and that all household rubbish is cleared away from the property daily and placed in the communal dustbins.

Damage to Villa and its Contents

Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the villa or their guests. Such damage must be reported to La Marina Services International CB immediately. The cost of the replacement or damage must be paid for by the hirer to the owner via La Marina Services International CB.

Rights of Access

La Marina Services International CB, their representatives and/or their subcontractors have the right of access to the villa at any reasonable time with due regard to the convenience of the hirer and their party for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work.

Responsibilities

La Marina Services International CB or their representatives cannot be held responsible for any events or circumstances beyond their control including, but not limited to, mechanical breakdown, illness, swimming pool maintenance, emptying of swimming pool for necessary maintenance, failure of any public service supply. The hirer responsible for the booking must take all reasonable measures to ensure that no one is allowed to perform any action that would endanger the property owners buildings and contents insurance policy or make the same void.

Injury and Damage

La Marina Services International CB acts as a booking agent on behalf of the owners of the properties we offer and, as such, your contract is with the owner. We do not have any responsibility to compensate you for any personal injury, illness, death, loss or damage of whatever nature suffered by you, or any member of your party, during the booking period or thereafter.

Accuracy of Information

We always take a great deal of care to ensure that the information and photography contained in this web site is correct and up-to-date. However, all our villas are privately owned and therefore from time to time owners may make changes in their homes to details like decoration, furniture and fittings. All information supplied by La Marina Services International CB is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure accuracy, but La Marina Services International CB and their representatives are not liable for any variation however caused.

Villa Arrival and Departure Times

Generally, the villa will be available for use from 3pm on the scheduled day of arrival and must be vacated by 11am on the scheduled day of departure. Any other arrival and departure arrangements must be agreed with La Marina Services International CB. 

Keys, Directions and Local Contact Numbers

Instructions for key collection and return, and directions to our office will be given with final booking confirmation. You will also receive a local contact telephone number of a representative working on behalf of La Marina Services International CB and/or the property owner should you have any problems relating to the villa and its contents.

Complaints

In the unlikely event that you have a complaint about the villa or its contents during your stay, it must be reported to La Marina Services International CB immediately who will take all reasonable steps to resolve the matter on behalf and in liaison with the owner of the property. La Marina Services International CB cannot accept liability for any complaint submitted after the completion of the hire period.

Building Work

In the event of building works taking place by local authorities, private developers or neighbours, it is important to note that we are not responsible for such work, are unable to stop such work taking place or unable to control the level of noise, neither can we be responsible for any building works that take place during a holiday.

‘Force Majeure’

The owners of the property and/or La Marina Services International CB shall not be liable for any failure to perform their obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity [or telephone service].

Law and Jurisdiction

La Marina Services International CB acts solely as an intermediary booking agent on behalf of the property owners. The rental contract is ultimately between the property owners and the hirer. Any disputes arising from the hire of the property will be resolved between the hirer and the owners.

This agreement shall be governed by the laws of Spain to which both parties agree to submit.

Insurance

The villa rental price does not include any personal, accident, medical or travel insurance cover of any kind. 

It is strongly recommended that the hirer obtains adequate and appropriate personal, accident, medical and travel insurance cover for themselves and all members of their party.
